HOW TO ENTER
Once you purchase a band you will be automatically entered unless you opted out of the promotion. Purchase a band these two ways:

SAVINGHOMES ACROSS AMERICA - ONE YEAR MORTGAGE PAYOFF PROMOTION RULES: All customers must be 18 or older. All entries must be have a valid purchase (declined credit cards or fraudulent checks, money orders, accounts and etc. will not be accepted) to be considered a valid entrant. All entrants must be a valid US citizen. All entrants must reside in the US and must have a primary residence in the US. All entrants must agree and understand that this is a promotion for one years' period (12 months) of payments for rent or a mortgage with a band purchase. No payments will be made to the customer; all payments will be made directly to the lender, lien holder, landlord etc. NO EXECPTIONS!  Prizes: The prizes will be presented on two levels (Level 1) $10 Band entry - This ten dollar purchase will enter the participant into the Level 1promotion for a 12 month (one year) rent/mortgage payoff. The participants' monthly payment can not exceed $1,000, in the event that the participant is entered into this prize level and their monthly rent/mortgage payment is more than the said $1,000 amount, the monthly payment of $1,000 will be made by the promotion and the participant will be responsible for the remaining monthly balance for the said 12 month period.
Coming soon.... (Level 2) $20 Band entry - This twenty dollar purchase will enter the participant into the Level 2 promotion for a 12 month (one year) rent/mortgage payoff. The participants' monthly payment can not exceed $2,500, in the event that the participant is entered into this prize level and their monthly rent/mortgage payment is more than the said $2,500 amount, the monthly payment of $2,500 will be made by the promotion and the participant will be responsible for the remaining monthly balance for the said 12 month period.  All participants agree to the release of all payment information for their creditor in order for payments to be made, in order to receive this promotional prize. See Winning Payout Info Sheet. If information is not released in a timely fashion or is refused, the participant will forfeit their winning prize. The drawing will be redrawn without that participant's entry and a new winner will be announced. If the winning participant is in arrears, the arrears amount will be paid first up to 12 months. Once the arrears have been satisfied the balance of the 12 monthly payments, if any, will begin on the following month until the 12 month period is satisfied. Participants can enter the promotion up to (5) five times per 30 day period. If a participant purchases more than 5 bands within a 30 day period, only 5 entries will be counted and entered for the promotion prize drawing.   HOW THE GRAND PRIZE WINNER WILL BE DETERMINED
Each purchase that is considered an eligible entry will be placed in the running for the promotion prize. Each prize level will have its own bucket. Once the allotted number of entries has been satisfied that prize level bucket will be closed and the prize drawing will be announced. The buckets will be comprised of 3000 entries, each participant, based on one entry per participant, will have the winning odds of 1:3000.  Once the prize level bucket has been closed out a new prize level bucket will begin.
OTHER TERMS AND CONDITIONS
In the event that there are not 3000 entries after a six month period, then there will be an alternate prize awarded. The alternate prize will be determined to by the number of entries.   By entering the promotion, all entrants consent to the use of their name, photograph, likeness, biography, voice and/or video for advertising and promotional purposes, including online announcements, worldwide and without limitation and without additional compensation except where prohibited by law.  The odds of winning depend upon the number of eligible entries received for the applicable drawing.

THE FOLLOWING CONTEST IS INTENDED FOR PLAY IN THE UNITED STATES ONLY AND SHALL ONLY BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW. DO NOT ENTER THIS CONTEST UNLESS YOU ARE LOCATED IN THE UNITED STATES AT THE TIME OF ENTRY.

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN AN ENTRY.

1. ELIGIBILITY: Open only to legal residents of any one of the 50 United States or the District of Columbia who are 18 years of age or older at time of entry. The following individuals are not eligible: Employees, contractors, directors and officers of SavingHomesAcrossAmerica.com s and each of their respective parents, subsidiaries and affiliated companies, distributors, Web design, advertising, fulfillment, insurance agencies, judging and Contest agencies involved in the administration, development, fulfillment and execution of this Contest (collectively, "Contest Parties").

2. CONTEST SCHEDULE: You may enter the Contest between 12:00:01 a.m. Eastern Standard Time ("EST") on August 15, 2011 and 11:59:59 p.m. EST on November 15, 2010 ("Contest Period") or until bucket is filled with participants.

3. TO ENTER: To enter the Contest, go to http://www.facebook.com/SavingHomesAcrossAmerica  like us and send your Name, Postal Address, Email Address, Phone (optional), Story and your video to info@savinghomesacrossamerica.com (“EMAIL”)  during the Contest Period. BY SUBMIT^TING YOUR ENTRY, YOU MUST EXPRESSLY AGREE AND CONSENT TO BE BOUND BY THE TERMS OF SERVICE AND PRIVACY POLICIES OF THE WEB SITE AND SavingHomesAcrossAmerica.com. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE SEND YOUR ENTRY OR ENTER THE CONTEST. Before entering the Submission, you will be required to agree that you have (a) read or have had these Official Rules read to you and you are in agreement with these Official Rules, and (b) received permission for the use of the image/likeness of any and all identifiable persons appearing in your Submission. You will be required to submit a release (to be provided by Sponsor) signed by each identifiable person appearing in your Submission granting Sponsor permission to use his or her image/likeness if your Submission is selected as a Finalist in the Contest. Submissions that do not include all required information and adhere to the Official Rules as determined by Sponsor in its sole discretion will be considered void. Once received, Submission will not be returned. Sponsor may, in its sole discretion, remove, delete and/or disqualify any Submission and/or Entrant it deems inappropriate or otherwise non-compliant.

CREATIVE ASSIGNMENT:
The creative assignment for the Contest ("Creative Assignment") is as follows:

  • Choose a commercial mood: Create a 30 second creative commercial or 60 second spot on your story  (why you deserve or what you would do with the 12 months of no rent or mortgage payments)

  • Get together your idea! It's up to you, make us proud!
  • Create and submit a 30-second or 60-second spot and send it with you Name, Postal Address, Email Address, Phone (optional), your Story to info@savinghomesacrossamerica.com

 

  • Your submission should be in commercial form consistent with these Official Rules.

JUDGING REQUIREMENTS:
Judging Criteria ("Judging Criteria") are as follows:

  • Originality and Creativity - 40%
  • REAL TALK (something from YOU, not what we want to see)- 30%
  • Overall Appeal - 30%

TECHNICAL REQUIREMENTS:
A Video File must be submitted:

  • Video File must be submitted – the Video file(s) must be exactly as possibly to the required seconds in length (all copyrighted material will be removed) (videos will be edited or discarded if they don’t comply with the requirements)
  • The Video file size should be kept at or under 100 MB for quicker upload/encoding time (max file size is 500MB)
  • Video Files must be provided in one of the following file formats: .MPEG; .MOV; .AVI; .WMV
  • We know you may not be experts so these will work also…
  •  
  • WebM files - Vp8 video codec and Vorbis Audio codecs
  • .MPEG4, 3GPP and MOV files - Typically supporting h264, mpeg4 video codecs, and AAC audio codec
  • .AVI - Many cameras output this format - typically the video codec is MJPEG and audio is PCM
  • .MPEGPS - Typically supporting MPEG2 video codec and MP2 audio
  • .WMV
  • .FLV - Adobe-FLV1 video codec, MP3 audio

 

 

For all video submissions shot in 16:9 aspect ratio, they should be center cut protected. Finalists may be asked to provide the original audio and video files used during production of the entry for broadcast purposes. This may include uncompressed QuickTime files, final audio mix and/or separate audio tracks for dialogue, music, and effects. These items are not mandatory to become a Finalist.

 

ADDITIONAL REQUIREMENTS:

  • Submission must be primarily in English.
  • All entries must be received before the SHAA bucket reaches 2,500 participants.
  • The person sending a Submission will be deemed the entrant ("Entrant"). The Entrant is the one (1) person who owns the email address. If any group elects to collaborate on a Submission, they are required to designate one (1) person as the agent of the group to enter the Contest, agree to these rules and accept the prize on behalf of the group. Neither Sponsors nor any of the Contest Parties are liable for any disputes between collaborators arising under or related to the Contest.
  • Each individual Entrant is allowed a total of five (5) Submissions, regardless of their spot selection.
  • Limit one (1) Finalist Prize per person, household and/or email address throughout the Contest Period.
  • Each Submission must comply with the Web Site and SavingHomesAcrossAmerica.com Terms of Service, as well as these Official Rules. In the event of any inconsistency between these Official Rules and the Terms of SavingHomesAcrossAmerica.com, the terms in these Official Rules shall prevail.
  • Each Submission must be the original work of the Entrant produced for this Contest; it may not have been entered in or won previous contests or awards; it may not have been published previously in any medium; it must not infringe any party's intellectual property or other rights; it must be suitable for display and publication on national television (e.g., may not be obscene or indecent, including but not limited to nudity or profanity); it must not contain obscene or pornographic material, it must not contain defamatory statements (including but not limited to words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation or socioeconomic group), it must not include threats to any person, place, business, group or world peace, it must not invade privacy or other rights of any person, firm or entity, and it must not in any other way violate applicable laws and regulations or network standards.
  • Each Submission must not feature or refer to any brands other than SHAA’ s info including but not limited to third party names, logos or trademarks on street signs, panoramic views, vehicle license plates, clothing such as T-shirts, hats, etc.
  • Each Submission must not feature distilled spirits (i.e. hard liquor), tobacco products (including cigarettes, cigars, pipe tobacco, chewing tobacco, and snuff), contraceptives, feminine hygiene products, fireworks, firearms and ammunitions, prescription drugs, illegal drugs and related drug paraphernalia, nutritional supplements, lotteries and gambling (including horse or dog racing and products or services related to gambling).
  • Each Submission must not utilize live animals unless the Entrant has obtained the consent of the animal's owner and an affidavit from the animal owner or wrangler that the animal was not harmed in the making of the commercial. Entrants are encouraged to contact the local Humane Society prior to filming the Submission to verify appropriate animal safeguards on set.
  • Each Submission must not contain any copyrighted works (other than as owned by the Entrant). You may not include any music except for the pre-approved music provided on the Web Site. Approved music provided on the Web may not be altered. Use of any unauthorized music may result in disqualification of Submission, in Sponsors' sole discretion.
  • Sponsors reserve the right in its sole discretion to remove or blur or to ask the applicable Entrant to remove or blur any non-material elements (e.g. small logos on clothing, artwork hanging in the background, etc.) rather than disqualify an otherwise compliant Submission.
  • If in Sponsors' determination it is necessary or advisable to make minor, non-material adjustments to an otherwise compliant Submission to comply with network specifications or requirements for viewing, Sponsors may, in its sole discretion, elect to do so, or may ask the applicable Entrant to do so. If Sponsors request Entrant to make these adjustments and Entrant chooses not to make these adjustments, Submission is subject to disqualification.

 

All Submissions will be reviewed for content before being published or judged; however, such review does not relieve Entrant from responsibility for compliance with all of the Terms of Service and these Official Rules. Submissions that do not comply in all material respects with the Terms of Services or these Official Rules or that otherwise contain prohibited, or inappropriate content as determined by the Sponsors, in its sole discretion, will be disqualified and will not be published or considered for prizes. Sponsors make the final determination as to which Submissions are eligible to take part in this Contest and be considered for a Finalist Prize. Certain Submissions may be featured from time to time on the Web Site during the Contest Period, in Sponsors' sole discretion; being selected as a featured Submission is unrelated to the Judging Criteria and does not guarantee selection as a Finalist in the Contest.

 

By entering this Contest and your Submission, you irrevocably grant to Sponsors and their agents the unconditional and perpetual right to post, display, publish, use, adapt, edit and/or modify such Submission in any way, in any and all media, for any purpose, without limitation, and without consideration to you. Finalists agree to irrevocably assign and transfer to the Sponsors any and all rights, title and interest in Submission, including, without limitation, all copyrights and waive all moral rights in Submission. All Contest Entrants further agree to release and indemnify and hold harmless the SavingHomesAcrossAmerica.com Entities (as defined below), Sponsors and the Contest Parties from any and all claims that any commercial, advertising, presentation, Web content or any other material subsequently produced, presented, and/or prepared by or on behalf of Sponsors infringe on the rights of Entrant's work as contained in any Submission.

4. SELECTION OF WINNERS: Five (5) finalist Submissions, (each a "Finalist") will be selected by a judging process in which a qualified panel of judges ("Judges") will evaluate each eligible Submission based on the Judging Criteria set forth above. In the event of a tie for the fifth Finalist spot the tie will be broken based on the highest score in the first Judging Criteria, continuing thereafter to each Judging Criteria in order, as needed to break the tie. The five (5) Finalist Submissions will be posted for the public (ages 13 or older) to vote on their favorite at the voting time. The voting time also known as the ("Voting Period"). At Sponsor's discretion, additional voting platforms may be available, including, but not limited to, via text and/or surveys, Etc... Check the Website for additional ways to vote for your favorite Submission(s), if any. Regardless of the number of voting platforms available; each person is limited to one (1) vote per day per platform. At the close of the Voting Period, the one (1) Submission, that received the highest cumulative score awarded by the Judges in the judging process described herein and did not make the Grand Prize Winner status by means of the Voting process, will be named a Grand Prize Winner (i.e., Per Category, one [1] Grand Prize Winners will be determined by the highest number of votes. In the unlikely event that public voting results in a tie, the tied Submissions will be re-judged by the Judges based on the Judging Criteria stated above. Any use of robotic, macro, automatic, programmed or like voting methods will void all such votes. Any attempt by Finalist and/or his/her family/friends to vote more than the number of times authorized herein using multiple names, email addresses, phone numbers and/or any other fraudulent mechanism, as determined by Sponsors in their sole discretion, shall give Sponsors the right to disqualify Finalist in its reasonable discretion. All Finalists are subject to verification, including without limitation, verification of eligibility, compliance with these Official Rules and completion of release forms (described below). If attempted notification is returned as undeliverable, if a Finalist cannot be verified, or if a Finalist is otherwise unable to accept prize, prize will be forfeited and may be awarded to an alternate Finalist provided sufficient time remains, in Sponsors' discretion.

 

Entrants agree that the Sponsors have the sole right to decide all matters and disputes arising from this Contest and that all decisions of Sponsors are final and binding. Finalists, by acceptance of the Finalist Prize (defined below), agree to release, indemnify and hold harmless Sponsors and Contest Parties, as well as each of their respective parent and affiliated companies, and each of their employees, representatives, contractors, and advertisers from any and all liability, loss, damage, cost or claim relating to any allegation regarding the acceptance or use of their prize, including but not limited to the airing of the commercial Submission.

 

If the actual, alleged or publicized conduct of any Entrant is illegal or, if any Entrant has been charged with or convicted of a crime, or in Sponsors' sole discretion is otherwise grossly offensive or violates generally accepted standards of behavior (including, but not limited to, illicit drug use or public intoxication) or otherwise leads the Sponsors to believe or conclude that the public association with the Entrant subjects Sponsors to ridicule, contempt, controversy, embarrassment or scandal, Sponsors in their sole discretion may disqualify Entrant and their Submission will no longer be eligible for this Contest.

5. PRIZE DETAILS:

FIVE (5) FINALIST PRIZES: Each finalist prize ("Finalist Prize") One entry for SavingHomesAcrossAmerica.com’s bucket.

ONE (1) GRAND PRIZE CONSULTING OPPORTUNITY: The one (1) Finalist whose Submission places highest in the Ad Meter rankings, even if it does not place in one of the top 3 Ad Meter spots, will receive Two entries for the SavingHomesAcrossAmerica.com’s bucket. Also consideration for future TV ad campaigns

 

6. GENERAL CONDITIONS: All Entrants must have a valid e-mail address. Finalists are solely responsible for any taxes on their respective prizes, and will receive an IRS Form 1099 for the value of their prize. No substitution of prize is offered, except at the sole discretion of the Sponsors. Prizes are non-transferable. Unclaimed prizes will not be awarded. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsors reserve the right to substitute prize with another prize of equal or greater value. If for any reason the Contest is not capable of running as planned, including without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, Sponsors reserve the right, at its sole discretion to cancel, modify or terminate the Contest. Further, Sponsors reserve the right, at its sole discretion, to disqualify any individual deemed to be (a) tampering or attempting to tamper with the entry process or the operation of the Contest or any Sponsors or Contest-related Web Site; (b) violating the Official Rules; (c) violating the Web Site terms of service, conditions of use and/or applicable general rules or guidelines; or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. This Contest is offered only in the United States and is governed by the laws of the state of New York. All claims relating in any manner to this Contest or to any Submission must be resolved in the federal or state courts located in New York, NY.

 

LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER OR VANDALIZE THIS WEB SITE OR INTERFERE WITH THE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND THE SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES AND DILGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

7. WINNER NOTIFICATION: Finalists will be notified by phone and/or email within two (2) weeks of the end of the Contest Period and will be required to complete, sign and return an Affidavit of Eligibility/Liability Release, and, where lawful, a Publicity Release Each person whose image, likeness and/or voice appears in a Finalist video must agree that he/she will execute a standard SAG Commercials Contract, will accept minimum scale compensation and talent residuals and will be bound by the terms and conditions of such contract, including exclusivity. Notification of Finalist status must be kept confidential until the Finalists are publicly revealed by Sponsors or your Finalist Prize will be forfeited and your Submission will not be posted for public voting as a Finalist Submission. Your Submission will not be posted for public voting as a Finalist unless the properly and fully completed Releases are received by Sponsors no later than three (3) days after notification of being a Finalist. Finalist Prize will be forfeited and an alternate Finalist may be selected if any required documents are not returned within the required number of days or if any mail is returned as undeliverable without forwarding address. The Grand Prize Winners will also be required to sign a prize acceptance form prior to their Submission. Sponsors reserve the right, to require a potential Finalist Prize winner to submit to a confidential background check to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the Contest will not bring Sponsors into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Contest as determined by Sponsors in its sole discretion.

 

Any waiver of any obligation hereunder by Sponsors does not constitute a general waiver of any obligation to Entrants. By accepting a prize, Finalist (or Finalist's parent or legal guardian if Finalist is a minor) agrees, and agrees in writing if requested, that the Submission will be deemed a Work Made For Hire under the Copyright laws of the United States, but if it cannot be so deemed, then the Finalist agrees to irrevocably assign and transfer to Sponsors all of his/her right, title and interest in and to his/her Submission, if any, including all but not limited to all copyright and trademark rights which he or she may have, in the United States and worldwide, therein, for consideration, the receipt and sufficiency of which is hereby acknowledged. Finalists hereby waive in favor of Sponsors, all rights of "Droit Moral" or "Moral Rights of Authors" or any similar rights or principles of law that Finalist may now or later have to his/her Submission. Sponsors reserve the right to alter, change or modify a winning Submission, in its sole discretion. Upon request of Sponsors, Finalist shall execute and deliver such additional instrument of assignment, as may be solely deemed by Sponsors, reasonably necessary to establish the ownership of record of the right, title and interest in and to the Submission and of the copyrights transferred and "Moral Rights of Authors" waived under these Official Rules. Should Sponsors fail to request the said assignment as stated, that shall not be deemed a waiver of Sponsors' rights and Sponsors may at a later time request the assignment.

8. LIMITATIONS OF LIABILITY AND RELEASE: No liability or responsibility is assumed by savingHomesAcrossAmerica.com (as defined below), Sponsors or Contest Parties resulting from any user's participation in or attempt to participate in the Contest or ability or inability to upload or download any information in connection with participating in the Contest. No responsibility or liability is assumed by SavingHomesAcrossAmerica.com, Sponsors or Contest Parties for technical problems or technical malfunction arising in connection with any of the following occurrences which may affect the operation of the Contest: hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other online communication problems; errors or limitations of any Internet service providers, servers, hosts or providers; garbled, jumbled or faulty data transmissions; failure of any e-mail transmissions to be sent or received; lost, late, delayed or intercepted e-mail transmissions; inaccessibility of the Web Site in whole or in part for any reason; traffic congestion on the Internet or the Web Site; unauthorized human or non-human intervention of the operation of the Contest, including without limitation, unauthorized tampering, hacking, theft, virus, bugs, worms; or destruction of any aspect of the Contest, or loss, miscount, misdirection, inaccessibility or unavailability of an email account used in connection with the Contest. SavingHomesAcrossAmerica.com, Sponsors and Contest Parties are not responsible for any typographical errors in the announcement of prizes or these Official Rules, or any inaccurate or incorrect data contained on the Web Site. Use of Web Site is at user's own risk. SavingHomesAcrossAmerica.com, Sponsors and the Contest Parties are not responsible for any personal injury or property damage or losses of any kind which may be sustained to user's or any other person's computer equipment resulting from participation in the Contest, use of the Web Site or the download of any information from the Web Site. By participating in the Contest, the Entrant releases Sponsors, Contest Parties and SavingHomesAcrossAmerica.com from any and all claims, damages or liabilities arising from or relating to such Entrant's participation in the Contest. By accepting a prize in the Contest, winners agree that the Sponsors, Contest Parties and SavingHomesAcrossAmerica.com shall not be liable for any loss or injury resulting from participation in the Contest, acceptance or use of any prize, or any travel related thereto. Sponsors, Contest Parties and SavingHomesAcrossAmerica.com are not liable in the event that any portion of the Contest, event or the event broadcast is cancelled due to weather, fire, strike, acts of war or terrorism, or any other condition beyond their control (a "Force Majeure Event"). Should a Force Majeure Event occur, Sponsors may, but is not obligated to, exercise commercially reasonable efforts to air the Grand Prize winning commercial at another time or make a reasonable substitution in its sole discretion.
